Early Police Department's Racial Profiling Policy

This Racial Profiling Policy is adopted in compliance with the requirements of the Texas Code of Criminal Procedure, which prohibits Texas peace officers from engaging in racial profiling.
Definition of Racial Profiling


Racial Profiling, by legislative definition, is any law enforcement initiated action based on an individual's raceethnicity, or national origin rather than on the individual's behavior or on information identifying the individual as having engaged in criminal activity (Art. 3.05, Texas Code of Criminal Procedure).


Acts Constituting Racial Profiling


Acts that constitute racial profiling initiates law enforcement action, such as a traffic stop, detention, a search, issuance of a citation, or an arrest based solely upon a person's race, ethnicity, or national origin based on racial or ethnic stereotypes.

Law enforcement action should be based upon a person's behavior, identifying the individual as having possibly engaged in criminal activity or other lawful reasons for the law enforcement action.
